Hello,
No it does not, depending on what your water contains as, sediment Limestone for instance is a depisitory mineral, it does not make up the hardness number but it will build up in a water faster than say Iron. So no Hardness does not effect the warranty, you will however have to follow the manufacturers recomendation for descaling the unit.

Answer: 
Typically sizing is done by flow rate and temperature rise of the incoming water temperature. The greater the BTU input to the tankless water heater the greater the temperature rise because the unit has more BTUs available to heat more water faster. For a four person home 199,000 BTU unit would be a good selection for replacing the 40 gallon water tank check out Grainger item number 20K868.
