Answer: 
The buttons can be installed to the top, however, the indicator and test button will not be visible or accessible from floor level as intended.

During a building inspection, your fire marshall may look for the LED indicator that you have power to the fixture. This inspector may also wish to test the fixture by pushing the test button. Neither of these possibilities will be easily achievable if the light and button are on top.

You will need to consult your local inspector for final approval to this matter.

Answer: 
No, the battery that comes with it is a sealed type. You should be able to mount it in any position.
