If an order is placed through Grainger.com, prices, taxes and freight estimates that appear at the time of checkout apply only for deliveries in the United States and are not applicable for deliveries in Peru. After the order has been placed, you will receive an e-mail from the Peru branch that reflects the final prices for your items as well as the availability of items. Once the customer confirms the prices and delivery time, Grainger Peru, SRL will proceed to process and invoice the order. If the items ordered are in stock, the order will be shipped in 24 hours.

Terms and Conditions of Warranty, Sales and Delivery

• ACCEPTANCE OF THE ORDER.-  Customer represents and acknowledges that valid purchase orders are only those that are accepted and verified in writing by GRAINGER PERU S.R.L., with Taxpayer I.D. No. 20547615469, domiciled at Av. Marie Curie No. 347, Urb. Industrial Santa Rosa, Ate, Lima (hereinafter "Grainger Peru") In addition, Customer acknowledges that the placement and acceptance of this order subjects it to the law and the jurisdiction of the Republic of Peru.

• SALES: Grainger Peru sells its products to those Customers with a customer number assigned by Grainger Peru. It may be the case that not all products and services offered by Grainger Peru are available in all areas of the country and/or at all times; therefore, the possession of this catalogue does not constitute an obligation for Grainger Peru to sell its products. In this sense, the delivery of the catalogue does not represent or may represent an offer to the Customer, but it will have a purely informational nature in respect of the products that Grainger Peru could offer.

In order to provide you with a better service, we recommend you (hereinafter "Customer") to register with and obtain a "Grainger Customer Number" for the purchase of products offered in this catalogue; this registration and number can be obtained by calling the Customer Service Department at telephone number 616-9100 from Monday to Friday from 8: 00 AM to 17: 00 P.M. and on Saturdays from 8: 00 A.M. to 12: 00 P.M.

• ILLUSTRATIONS OF PRODUCTS IN THE CATALOGUE: Grainger Peru has tried to accurately illustrate and describe the products appearing in the catalogue and on the website: www.grainger.com. However, the illustrations and descriptions mentioned are only intended as preliminary information, identification and do not represent or establish any offer, obligation or warranty whatsoever either express or implied, that the products are fit for a particular purpose, or that the product will necessarily match the illustrations or descriptions. Only when Customer has issued an order and Grainger Peru has received it, the latter will provide information regarding the product Customer wishes to purchase. In case the respective information is not provided to you, it shall be understood that the required product complies with the characteristics set forth in the catalogue.

In an effort to illustrate the products, their operation or installation, they have been depicted next to objects or accessories; however, this does not mean that those items or accessories are part of the product sold. Grainger Peru does not make, furnish or authorize the granting of any warranty or affirmation of fact, express or implied, other than those laid down in this Limited Warranty statement.

• USE OF THE PRODUCT. Grainger Peru is not responsible for the way in which the product is installed or used. It is Customer's sole responsibility prior to sending a purchase order and use a product in particular, to analyze the characteristics and details thereof to make sure that the product, its application, installation and use comply with all operational provisions applicable. Moreover, Grainger Peru is not responsible for the use, installation or utilization of the product, in contravention of the applicable legal rules.

• CROSS REFERENCE INFORMATION: Comparisons among products in the catalogue do not imply that all products compared are available or, in the case of equivalent products, that they are a substitute for the former or that the performance or other characteristics thereof are perfectly comparable or functional. It is Customer's sole responsibility to review before buying and using a product and analyze the characteristics and details of the Required Accessories, Alternative Items or Optional Accessories to make sure that the product, its application, installation and use comply with its needs; also, Customer will be liable for an incorrect or inappropriate use thereof or for the result of a wrong selection of the required product.

To this end, Grainger Peru will provide the essential information regarding the product required from the Customer.

• ACT OF GOD OR FORCE MAJEURE: Customer may not require compliance with any of the obligations assumed by Grainger Peru, during the time and/or to the extent that such compliance will be delayed, hindered or prevented by events of force majeure or acts of God, pursuant to Article 1315 of the Civil Code.

          Accordingly, Grainger Peru is not liable for the failure to perform its obligations hereunder or for the partial, late or defective compliance therewith, when this is caused by events, conditions or circumstances not attributable to Grainger Peru, and which are extraordinary, unforeseeable and irresistible, such as:

• Strikes, lockout, concerted acts of workers or other industrial disturbance;
• Fire, explosion, flood, earthquake or other natural disaster;
• Civil unrest, riot or armed conflict declared or undeclared;
• Restrictions, scarcity, rationing or appropriation of normal sources of manpower, materials, transport, energy or other services; and,
• Accidents.

          Grainger Peru is not obliged to make any concession or to comply with any demand or any requirement whatsoever to end any strike or other concerted acts of workers.

I. LIMITED WARRANTY:
WARRANTY "A" APPLICABLE TO ELECTRONIC AND ELECTRICAL PRODUCTS

• DURATION. This warranty will be valid for one calendar year, counted from the date of purchase from Grainger Peru, in accordance with the date set forth in the invoice of purchase of the product, except in the case of systems for the application of paint for heavy duty service, which shall be valid for three years.

• SCOPE: Except for products on sale, all products sold by Grainger Peru are warranted. The warranty covers the new product and all parts thereof against any manufacturing defect of the product purchased and labor for repairs, if necessary. This warranty also covers normal consumable items for a period of thirty days from the date of purchase from Grainger Peru against defects in material and workmanship. These consumables are: HVLP filters, motor brushes, gun packing, gun tank seal, retention valve of the gun and gun air flow ring, no air entry valve, outlet valve, gun valve, filters, nozzles, all joints and "O" rings. The foregoing applies provided the product is operated or used under normal conditions of use and handling. All products or parts that according to Grainger Peru have manufacturing defects, will be repaired or replaced at the sole option and discretion of Grainger Peru.

Only if Grainger Peru has engaged in willful misconduct or gross negligence in the fulfillment of its obligations, Customer expressly releases Grainger Peru from any liability related to hidden defect, error or omission in the product, or in the description thereof, or the failure of the supplier, dealer, seller, manufacturer or builder of the product to deliver same; therefore Customer expressly waives the right of compensation in accordance with the applicable provisions of the Civil Code.

• EXPIRATION: the product warranty will expire automatically in any of the following cases: a) when the product had been used in conditions other than normal; b) when the product has not been operated according to the accompanying instructions for use; c) when the product has been altered or repaired by persons not authorized by Grainger Peru.

• THEFT.- This warranty does not cover theft of the product.

• EXCLUSIONS.- This warranty specifically excludes: a) any loss, consequential, or indirect, incidental or subsequent damages of any kind, including, without limitation, compensation, reimbursement or damages on account of the loss of present or future profits or for any other reason, arising from any defect, failure or malfunction of the product warranted hereby; therefore the purchaser’s sole and exclusive remedy of any type, regardless of the legal concept, shall not be greater than the purchase price of the product in respect of which the corresponding claim has been made; b) goods or services normally required for the product's maintenance:  HVLP filters, motor brushes, gun packing, gun tank seal , retention valve of the gun and gun air flow ring, no air entry valve, outlet valve, gun valve, filters, nozzles, all joints and "O" rings or any other consumable parts not specifically indicated, since as stated above they will be covered only for thirty days from the date of original purchase; c) any implied warranties, including those of sale and suitability for a specific purpose.

• MECHANISM TO ENFORCE THIS WARRANTY: In order to enforce the warranty in accordance with the terms outlined above, before returning any product Customer shall be required to call Grainger Peru's Customer Service Department on Monday to Friday from 8:00 A.M. – 17:00 P.M., and on Saturdays from 8:00 A.M. – 12:00 P.M. provide the date and number of the invoice covering the purchase of the product from Grainger Peru, clearly describe the defect observed in the product purchased and request its warranty report number.

Then the product must be delivered to Grainger Peru, making reference to the warranty report number that was assigned. If the warranty is admissible, Grainger Peru will absorb the costs of transport.

In case of any doubt or problem with your shipment report it before the end of the period of two days following receipt of the product.

Carriers are not allowed to pick up products without the express authorization of Grainger Peru. By virtue of the foregoing, Grainger Peru will not be responsible for the products delivered to carriers without prior and express authorization of Grainger Peru.

Title to and risk of loss of the products purchased is transferred to Customer at the time of their delivery to the carrier. If the product was damaged in transit, the recipient must make the corresponding claim directly to the carrier. As an additional service, Grainger Peru may assist Customer in the event of a Product damaged by the carrier, provided the above provisions are followed.

II. WARRANTY "B"  APPLICABLE TO THE ENTIRE RANGE OF OUR PRODUCTS, WITH THE EXCEPTION OF ELECTRONIC AND ELECTRICAL PRODUCTS

• SCOPE: Except for products on sale, all products sold by Grainger Peru are warranted. The warranty covers the new product and all parts thereof against any manufacturing defect of the product purchased and labor for repairs, if necessary. • CONDITIONS.-  EXPIRATION: The product warranty will expire automatically in any of the following cases: a) deterioration or damage of goods by negligent use or accident not attributable to Grainger Peru; b) improper installation or maintenance; c) abnormal operating conditions; d) alteration, adjustment or modification; e) a purpose or application different in any way from that for which it was designed; f) failure to comply with instructions for use; g) normal wear of the product; i) removal or alteration of any safety device of the product.

• THEFT.- This warranty does not cover theft of the product.

Then the product must be delivered to Grainger Peru, making reference to the warranty report number that was assigned. If the warranty is admissible, Grainger Peru will absorb the corresponding costs of transport.

• PRODUCT RETURN OR CANCELLATION: Any cancellation of purchase orders must be previously authorized by Grainger Peru. In this case and in order for such cancellations to be admissible, it will be required that the product may be re-warehouse, in its original packaging, not show damage and that it has been acquired during the thirty calendar days immediately prior to the request for return. Grainger Peru does not accept the return of products that are personalized, custom-made or sold on request. The return of products will be subject to charges for shipping and handling which must be borne by customer, except for failures of service by Grainger Peru that may arise. The return of products on sale is not accepted.

In order to request the cancellation or return of products in accordance with the terms outlined above, before returning any product Customer shall be required to call Grainger Peru's Customer Service Department on Monday to Friday with no cost at 0800-00-789 from 8:00 A.M. – 17:00 P.M., and on Saturdays from 8:00 A.M. – 12:00 P.M. provide the date and number of the invoice covering the purchase of the product from Grainger Peru, clearly describe the reason why the return is being requested request its warranty report number.

Then the product must be delivered to Grainger Peru, making reference to the number of the request for return that was assigned when the report was made to Grainger.

User/Customer agrees that any balance that may result in its favor from sales transactions and/or product returns will be applied within three months after the date on which it was generated. If such favorable balance is not applied or is not requested by user/customer within the term referred to above, said balance or its remnant will be subject to cancellation, and Grainger Peru will have no further responsibility to make such refund.

• DOCUMENTS THAT BACK MANUFACTURERS' WARRANTY AND/OR SALES LITERATURE: All products sold by Grainger Peru are for retail or distribution. In addition to the warranty granted by Grainger Peru, most of the products listed in this catalogue are warranted to Customer directly by the manufacturer or producer. These warranties are delivered with the product and generally cover defects of manufacture of the products for one year from their purchase from Grainger Peru in accordance with the date appearing on the invoice of purchase of the product, unless otherwise established in the manufacturers' warranty. As an additional service, Grainger Peru may request copies of the warranties of its products to manufacturers or producers and will provide them to Customer free of charge upon request. Grainger Peru may also provide sales brochures and other literature provided by the manufacturer or producer. In providing this service, Grainger Peru assumes no responsibility concerning the content of the warranties or sales literature of the manufacturer or producer of the products

• TERMS OF PURCHASE: The acceptance of any purchase order is subject to the acceptance by Customer of all and every one of the terms and conditions set forth in the General Terms of Use, Terms of Purchase and in the Registration Application available in detail at our web site: www.grainger.com.  It shall be presumed that Customer has expressly accepted such terms by the receipt by Grainger Peru of any Customer purchase order or the acceptance, in whole or in part, of the goods or services requested. Any other terms and conditions to the contrary are expressly rejected, and any addition to or modification of the terms and conditions are binding upon Grainger Peru unless expressly consented to by Grainger Peru in writing.

• LAW AND JURISDICTION: This agreement is governed by the laws of Peru. For all matters not covered in this agreement, Peruvian laws are applied on a supplementary basis. Similarly, any controversy, dispute or claim arising during the performance hereof falls under the jurisdiction of the courts of the Judicial District of Cercado de Lima, Peru.

• ENTIRE AGREEMENT: The terms and conditions described in the web site: www.grainger.com called General Terms of Use, Terms of Purchase, as well as forms, Application Registration, quotations, invoices and the terms and conditions of sale by catalogue, are incorporated by reference into the Terms of Purchase and constitute the entire and exclusive agreement between Customer and Grainger Peru.
